Appraisers Only - This service is offered to professional real estate appraisers only, and those persons associated with the appraiser who established the account.
No SPAM! No Bulk Emailing!. Customer shall not use this service for chain letters, junk mail, spamming, bulk emailing, or any use of distribution lists to any person who has not given specific permission to be included in such a process. Client also shall not engage in any unsolicited email practices at AppraiserMail.com, or otherwise, that mentions or reference AppraiserMail.com in the body of the email sent. We have a zero tolerance for sending unsolicited email! Any user doing this will have their account immediately terminated with no refund given. In addition any penalties incurred by AppraiserMail.com as a result of customer spamming or bulk emailing will be passed on to the customer or collected in a court of law if need be.
Acceptable Use - Customer agrees that it will not distribute, electronically transmit or display any materials which:
- violate any state, federal or foreign laws or regulations;
- infringe on any intellectual property rights (e.g., copyright, trademark, patent or other proprietary rights) of AppraiserMail.com or any third party;
- are defamatory, slanderous or trade libelous;
- are threatening or harassing;
- are discriminatory based on gender, race, age or promotes hate
- contain viruses or other computer programming defects which result in damage to AppraiserMail.com or any third party.
30 Day Money Back Guarantee -
If customer is not satisfied with this service they may receive a full refund of money paid, if they notify support before 30 days have elapsed. The date of the "welcome" email will be the beginning of the 30 day money back guarantee time period.
Payment Obligations - Any account that becomes 30 days over due will be considered delinquent and will be cancelled. All email stored on the AppraiserMail.com servers will be deleted for the cancelled account.
Termination - AppraiserMail.com reserves the right to refuse service to anyone. AppraiserMail.com, in its sole discretion, may immediately terminate this Agreement if the customer engages in any practice that is prohibited by these terms.
DISCLAIMER OF WARRANTY -
THE SERVICES OF APPRAISERMAIL.COM, INCLUDING WITHOUT LIMITATION, ALL PRODUCTS AND SERVICES DISPLAYED OR OFFERED ON THE APPRAISERMAIL.COM, AND ALL TEXT, GRAPHICS, LINKS AND APPLICATIONS ARE PROVIDED TO CLIENT ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND. APPRAISERMAIL.COM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EACH OF THE FOREGOING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING FROM A COURSE OF DEALING. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, APPRAISERMAIL.COM SPECIFICALLY DISCLAIMS ANY WARRANTY THAT (1)THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (2) DEFECTS WILL BE CORRECTED; (3) THERE ARE NO VIRUSES OR OTHER HARMFUL COMPONENTS; AND (4) THE SECURITY METHODS EMPLOYED WILL BE SUFFICIENT.
LIMITATION OF LIABILITY -
IN NO EVENT SHALL APPRAISERMAIL.COM BE LIABLE FOR DAMAGES RESULTING FROM LOSS OF DATA, PROFITS, USE OF THE APPRAISERMAIL.COM SITE OR ANY APPRAISERMAIL.COM ONLINE PRODUCTS OR SERVICES, OR FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THIS AGREEMENT OR IN CONNECTION WITH ANY PRODUCTS OR SERVICES PROVIDED HEREUNDER. IN NO EVENT SHALL APPRAISERMAIL.COM CUMULATIVE LIABILITY EXCEED AN AMOUNT GREATER THAN FIVE HUNDRED DOLLARS ($500 US).
